If you grab the guy when he is “out” of his car, then you’re only facing the “misdemeanor” charge of “battery,” BUT if you reach in and touch the guy while he is STILL in his car, then you’re facing a serious “felony” (assuming you do this in Florida) called “Burglary of a Conveyance” (“conveyance” meaning a car or truck or any vehicle) and this scores out to thirty (30) months in Florida State Prison!

Yes, many of you know me as a federal criminal lawyer and this is true; but I can tell you with authority as a Ft. Lauderdale criminal defense lawyer and also as a statewide Florida criminal lawyer who handles cases ALL across Florida, that the Florida Legislature is essentially making the statement that, the integrity of the airspace within your vehicle is almost sacrosanct, almost like your privacy in your home, damn near; and you have the right to feel safe and secure within the private confines of your car, to be protected against the harms imagined by a stranger reaching in and touching you against your will. This was the legislative intention behind this new law/statute. Be careful; it’s best to get the guy’s tag number and call 911, rather than get arrested for this felony and face serious prison time. Cool off, knowing that real justice will prevail, though a lot slower, we all know.
